Naples, Italy (4E) – “Si, amico mio” there’s an Italian clothing company named “Steve Jobs,” and it recently won a trademark battle against Apple, Inc., which sued again to prevent the Italian company from using its company logo that seems to resemble the iconic Apple logo.
The decision by the Italian court means that Steve Jobs (the clothing company) founded by brothers Vincenzo and Giacomo Barbato in Naples in 2012, can now use the name Steve Jobs to brand its clothing, and its apple-inspired logo on their clothing and other products.
The Barbato brothers told Italian media they discovered the name Steve Jobs wasn’t trademarked in Italy (and anywhere in the world) in 2012 so they decided to use this high-recall name for their company.
Of course, Apple was none too pleased when it learned a pipsqueak Italian clothing start-up had registered its founder’s name as its company and brand name. Apple sued the brothers in 2014 over its logo.
The Steve Jobs logo is shaped like a “J” with a bite taken out. It also sports a multi-colored apple leaf. The European Union’s Intellectual Property Office, specifically its Office for Harmonization in the Internal Market ruled in favor of the Barbato”
In August 2014, the office proclaimed that “The opposition is rejected in its entirety.”
Apple then sued the brothers in an Italian court over the same issue. The court ruled that the letter “J” isn’t edible and “it cannot be a bite” portrayed in the Apple logo, so the brothers can trademark the logo.
The brothers Barbato are currently manufacturing T-shirts, jeans, and accessories stamped with their Steve Jobs brand and logo. The “fratelli,” however, admitted their main goal is to sell electronics devices — and even an Android smartphone they plan to call the “Steve Jobs Phone.”
“We are working on a line of highly innovative electronic devices, projects we have been working on for years,” said the brothers.
They say they’re looking for partnerships and “are in talks for a production of electronics products with a Chinese brand.”
The brothers recently registered the Steve Jobs name globally.
